iO Photos Terms of Use

iO Photos is a feature of iO made available by CSC Holdings, LLC ("Cablevision") to enable Subscribers to access through their iO cable television box photographs that Subscribers or their family and friends have published or posted to popular online photo services such as Facebook, (the "Photo Sites"). Access to and use of iO Photos is subject to the following Terms of Use as well as the Agreement for iO, Cablevision Subscriber Privacy Notice, and Cablevision's Copyright Infringement Policy which are incorporated herein by reference, as they may be updated from time to time, as well as any other agreements governing Subscriber's use of these third party Photo Sites. Capitalized terms used herein but not defined shall have the meanings ascribed to them in the Agreement for iO.

iO Photos is currently only available to residential iO Subscribers and commercial iO Subscribers, except those commercial customers subscribing to the iO Entertainment package and iO TV Total Entertainment package, in good standing with a digital iO cable box.

Access to and use of iO Photos is provided on an "AS IS" and "AS AVAILABLE" basis. Cablevision makes no warranty or guarantee that iO Photos shall be uninterrupted or error-free and shall not be liable or responsible for any errors, losses, or interruptions in connection with Subscriber's use of iO Photos, including but not limited to intermittent service, and inability to access photographs. Subscriber represents and warrants that Subscriber shall only access those Photo Sites to which Subscriber has the requisite rights and permissions to access. iO Photos is designed to enable a Subscriber to access and view photographs on the Subscriber's television set, for in-home/office, personal viewing, that the Subscriber is authorized to access and view directly on a Photo Site. It is not intended to be used for the dissemination or distribution of content that infringes third party intellectual property rights, including copyrights, or that otherwise violates the law, and Subscriber expressly represents and warrants that Subscriber will not use iO Photos to disseminate or distribute such infringing or unlawful content. Pursuant to the Digital Millennium Copyright Act and other applicable laws, Cablevision reserves the right, in its sole discretion, to suspend or terminate, in appropriate circumstances, access to iO Photos for any Subscriber who Cablevision reasonably believes to be infringing third party copyright or other intellectual property rights, including repeat infringers, or is using iO Photos in a manner that otherwise violates the law.

Subscriber agrees that Cablevision may for any reason, and without notice to you, modify or terminate iO Photos or access to any Photo Site and these Terms of Use without liability to you, any user or any third party.

iO Photos Facebook Application. Subscriber grants Cablevision the right to enable the iO Photos Facebook application (the "Facebook Application") to connect to Subscriber's Facebook account by either (1) authorizing the connection via the Facebook connect button available to Subscriber when logged into Optimum.net or (2) authorizing the connection by logging into Facebook.com directly through Subscriber's iO cable box. By granting Cablevision the right to enable the Facebook Application and to connect to Subscriber's Facebook account, Subscriber expressly consents to the use of Cablevision's system to enable Subscriber to transmit photographs from Subscriber's online Facebook account to Subscriber's iO cable television box for personal, in-home/office viewing by Subscriber on Subscriber's television set. Subscriber acknowledges that Cablevision will be passing Subscriber's Facebook email and password to Facebook for authentication but Cablevision does not store Subscriber's Facebook password and Cablevision has no direct access to or ability to view Subscriber's password at any time. Subscriber will have "view only" access to certain portions of Subscriber's Facebook account through the Facebook Application, and will not be able to post, edit or modify any content on that account through the Facebook Application and no content will be permanently stored by Cablevision. Subscriber agrees that in addition to these Terms of Use, Subscriber shall abide by all Facebook Terms and Policies when accessing their Facebook account through the Facebook Application. Subscriber acknowledges that the Facebook Application is not endorsed or sponsored by Facebook.
